She v. You

Leveling The Playing Field

Although family law is intended to be gender-neutral, the outcomes in divorce and family law matters don't always turn out that way.   There are various reasons to explain this phenomenon, not the least of which is political correctness. 

It is politically correct and rightfully so, for women in the workplace to be viewed and treated equally to their male counterparts.  However, in divorce, it's politically correct to view women as victims.

Alimony

The concept of imputing income is used when the courts calculate any alimony award.  Although there is no published New Jersey case mandating the imputation of income to a custodial parent who chooses to stay at home with the children, when a court establishes any alimony award, if income is imputed to a stay-at-home mother, then the amount of alimony will be reduced.

Therefore, developing a legal argument to support your position that your stay-at-home spouse should be imputed an income commensurate with her ability, education, experience and earnings potential is critical.  Developing the legal strategy to ensure fairness in the court's decision to award alimony and if so how much, relies on many factors.   

 A case by case review, requires a strategy to be set forth by your atorney so that the court will consider the following in determining how much income to impute to a your stay-at-home spouse;

  1. The age, health, maturity, and number of children in your home;

  2. Your stay-at-home spouses employment history;

  3. The age and health of your stay-at-home spouse;

  4. The availability of an adequeate child-care provider;

  5. The relationship between the expense of childcare and the net income of your stay-at-home spouse;

  6. The cost associated with the transportation  required (if any)  for your stay-at-home spouse to have imputed income;

  7. Your stay-at-home spouse's motivation or reasoning for being at home; and

  8. The adequacy of available resources if the custodial parent remains at home.
